Welcome to Sowaka.in, operated by Sowaka Pvt. Ltd. ("Sowaka," "we," "us," or "our"). By accessing or using this website and placing orders, you agree to be bound by these Terms & Conditions ("Terms").

By using this website and placing an order, you confirm that you are at least 18 years of age. Browsing this website is open to all users; however, all purchases must be made by an adult (18 years or older). Sowaka is not liable for purchases made by minors without parental consent.

We reserve the right to update, modify, or replace any part of these Terms at any time. The revised Terms will be effective upon posting on this page. Continued use of the website after any changes constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.

2. Products & Availability

Sowaka offers baked goods and snack products, including cookies, brownies, energy bars, and related food items.

  • All products are subject to availability at the time of order.
  • We reserve the right to discontinue, modify, or introduce products without prior notice.
  • Product images displayed on the website are for illustrative purposes only; actual appearance, size, or packaging may vary slightly.
  • Ingredients, flavours, nutritional information, and packaging may change based on availability, supplier updates, or seasonal factors. Please review the physical product label before consumption.

3. Pricing & Payments

All prices listed on this website are in Indian Rupees (₹) and are inclusive of applicable Goods and Services Tax (GST) unless explicitly stated otherwise.

  • Pricing changes apply to future orders only. The price confirmed at the time of order placement is final and binding for that specific order.
  • Full payment must be received before your order is processed and dispatched.
  • We accept payments through secure, approved payment gateways available on the website.
  • Sowaka does not store your payment card details. All payment transactions are processed through PCI-DSS-compliant third-party payment processors.

4. Order Acceptance & Cancellation

Once an order is placed, you will receive an order confirmation via email or WhatsApp message.

  • Cancellation window: Orders may be cancelled within 15 minutes of placement by contacting us at concierge@sowaka.in or through the cancellation option on your order page.
  • Once your order has entered production or has been dispatched, cancellations cannot be accepted due to the perishable nature of our products.
  • We reserve the right to cancel or refuse any order due to product unavailability, pricing errors, suspected fraudulent activity, or other unforeseen circumstances. In such cases, a full refund will be issued promptly.
  • In the event of a Sowaka-initiated cancellation, you will be notified, and any payment made will be refunded within 5–7 business days to the original payment method.

5. Food Safety & Allergies

Sowaka operates under FSSAI License No. [12724055001028] and complies with the Food Safety & Standards Act 2006 and all applicable regulations thereunder, including the Food Safety and Standards (Labelling and Display) Regulations 2020.

Our products may contain or come into contact with common allergens, including:

  • Tree Nuts (Walnuts, Hazelnuts, and others)
  • Dairy (Milk, Butter, Cream)
  • Gluten (Wheat, Oats)
  • Soy

All declared allergens are listed on product packaging in compliance with FSSAI requirements. Customers are responsible for reviewing the physical product label before consumption. If you have a known allergy or dietary restriction, please contact us at concierge@sowaka.in before placing an order.

Sowaka is not liable for allergic reactions arising from undisclosed personal sensitivities not covered by our declared allergens, or from failure to read the product label provided.

6. Storage & Consumption

Our products are perishable and must be stored as directed on the product packaging.

  • Best taste and freshness are guaranteed when consumed within the recommended timeframe printed on the packaging.
  • Sowaka ensures products are packaged appropriately to maintain quality during transit.
  • We are not responsible for deterioration in quality caused by improper storage or handling after the product has been delivered in satisfactory condition.

7. Shipping & Delivery

  • Delivery timelines communicated at checkout are estimates and may vary based on your location, courier availability, and other factors.
  • Sowaka ensures products are handed over to the delivery partner in proper condition and appropriate packaging.
  • Damage caused solely by third-party courier handling is subject to the courier partner's own liability and claims policy; Sowaka will assist in facilitating such claims where possible.
  • We are not liable for delays caused by third-party shipping providers, adverse weather, natural events, or other circumstances beyond our control.
  • Customers are responsible for providing accurate and complete delivery details. Incorrect or incomplete addresses may result in delayed, failed, or returned deliveries. Re-delivery charges, if applicable, will be borne by the customer.

8. Refunds & Replacements

Due to the perishable nature of our products, the following policy applies:

  • Refunds or replacements are considered only for items that are damaged, defective, or incorrect upon delivery.
  • Claims must be submitted within 48 hours of delivery by emailing concierge@sowaka.in with your order details and supporting photographs of the issue.
  • Claims submitted beyond this window due to circumstances outside the customer's control (such as delayed delivery confirmation or public holidays) will be reviewed at Sowaka's discretion.
  • Sowaka reserves the right to determine eligibility for refunds or replacements based on the evidence provided.
  • Approved refunds will be processed within 7–10 business days to the original payment method.

9. Intellectual Property

All content on this website, including but not limited to logos, brand identity, product names, descriptions, images, packaging designs, and written content, is the exclusive property of Sowaka Pvt. Ltd. and is protected under applicable Indian intellectual property laws.

No content may be copied, reproduced, modified, distributed, or used for commercial purposes without prior written permission from Sowaka Pvt. Ltd. Unauthorized use may result in legal action.

10. User Conduct

By using this website, you agree not to:

  • Use the website for any unlawful or unauthorized purpose
  • Submit false, misleading, or fraudulent information

Nothing in this clause limits or excludes Sowaka's liability for matters that cannot be lawfully excluded under applicable Indian law, including the Consumer Protection Act 2019 or the Food Safety & Standards Act 2006.

12. Grievance Redressal

In accordance with the Consumer Protection Act 2019 and the Consumer Protection (E-Commerce) Rules 2020, we have appointed a Grievance Officer to address customer concerns:

If you are not satisfied with our resolution, you may approach the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act 2019.

Your personal information is collected, stored, and processed in accordance with our Privacy Policy, which forms a part of these Terms. By using this website, you consent to the practices described in our Privacy Policy.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Gautam Buddha Nagar
